A financial investor wished to recruit a finance director to one of its investee companies. That individual was being threatened with legal proceedings for personal liability if he were to accept the position. This threatened litigation was preventing the sale of the investee company from proceeding.

The individual wanted protection against his personal liability in the event he suffered loss arising from the dispute.

We issued a policy where the individual was the beneficiary such that he felt sufficiently protected to proceed to accept the position. We worked collaboratively with the financial investor, individual and lawyers to issue a bespoke policy. The financial investor could proceed with the sale which completed successfully.
